JUDICIAL SERVICE COMMISSION’S DECISION ON THE COMPLAINT LODGED BY MS ANDISWA MENGO AGAINST JUDGE PRESIDENT SELBY MBENENGE OF THE EASTERN CAPE DIVISION OF THE HIGH COURT
On 7 July 2026, the Judicial Service Commission (JSC), excluding the members designated by the National Assembly and the National Council of Provinces, held a meeting in terms of section 20(1) of the Judicial Service Commission Act 9 of 1994 (JSC Act), to consider written submissions from the parties on whether the JSC should advise the President to suspend Judge President Mbenenge in terms of section 177(3) of the Constitution.
At this meeting, the JSC resolved to advise the President to suspend Judge President Mbenenge from his duties pending the decision of the National Assembly as contemplated in section 177 of the Constitution.
