The Judicial Conduct Tribunal Hearing for Judge M K Parker

The Judicial Conduct Tribunal will hear complaints against Western Cape High Court Judge M K Parker from 24-28 February 2025. These serious allegations, brought by ten judges of the Western Cape High Court and the Cape Bar Council, could result in impeachment if proven.

The Tribunal will examine two key complaints:

  • Lying under aath – Judge Parker initially alleged he was assaulted by Judge President John Hlophe in an affidavit but later contradicted himself in a second affidavit.
  • Failure to disclose financial misconduct – Parker is accused of omitting critical information in his application and interview for judicial appointment, particularly regarding his former law firm’s alleged misuse of R8 million in client funds.

The Tribunal will be presided over by retired Gauteng High Court Judge President Bernard Ngoepe, alongside retired Judge P Boruchowitz and Ms D Mthimunye as a non-judicial member. The hearings will be held virtually.

25 February 2025 Update: 

The Judicial Conduct Tribunal into Judge M K Parker wrapped up witness testimonies on 24 January 2025 in a marathon session that saw all 10 witnesses testify in a single day.

Witnesses included:
– Eight current and former Judges of the Western Cape High Court
– Advocate Andrew Breytenbach SC
– Mr Irfaan Parker (Judge Parker’s brother & former law firm partner)

The Tribunal has now been postponed to 29 April 2025, when closing arguments will be heard. The outcome of this case could have major consequences for judicial accountability.
