The cases involving Judge Hlophe illustrate the structural weaknesses within the judicial misconduct system perfectly.
The Judicial Service Commission has failed to deal with the complaint against Judge Makhubele effectively or efficiently. To us, this raises serious concerns about how the Judicial Service Commission (JSC) carries out its constitutional responsibility of holding judges accountable for misconduct.
Serious allegations of judicial bribery and corruption have emerged from the State Capture Commission. They must be investigated. But who can do this?
